  • 1. Terms
    1.1. The client agrees that the website is developed and delivered as per the approved scope of work and specifications.

    2. Review and Approval
    2.1. The client confirms that they have reviewed and approved all content, design, and functionality before the website is made live.
    2.2. The client acknowledges that post-launch changes or errors resulting from incorrect or incomplete information provided by the client will incur additional costs.

    3. Compliance with Laws
    3.1. The client is responsible for ensuring that all content, images, and other materials provided for the website comply with Malaysian laws, including but not limited to:
    The Personal Data Protection Act 2010 (PDPA) for data protection and privacy.
    The Communications and Multimedia Act 1998 (CMA) for prohibited and offensive content.
    3.2. The service provider shall not be held liable for any legal violations due to client-provided content.

    4. Intellectual Property
    4.1. The client confirms that all materials, content, and intellectual property provided for the website do not infringe any third-party rights.
    4.2. The service provider retains the intellectual property rights of custom code, designs, or elements created unless explicitly transferred to the client via a separate agreement.

    5. Payment Terms
    5.1. The client agrees to pay all outstanding balances, as specified in the invoice, before the website goes live.
    5.2. The service provider reserves the right to delay the website launch until payment is made in full.

    6. Hosting and Domain
    6.1. The service provider will not be responsible for hosting or domain-related issues unless explicitly stated in the agreement.
    6.2. The client agrees to maintain hosting and domain services compliant with Malaysian regulations.

    7. Post-Launch Support
    7.1. The client acknowledges that post-launch support is not included unless agreed otherwise under a maintenance contract.
    7.2. Any support requests after launch will be charged at the provider's standard hourly or project rates.

    8. Limitation of Liability
    8.1. The service provider shall not be held liable for:
    Loss of business due to website downtime or errors.
    Breaches caused by third-party plugins, hosting issues, or cyberattacks.
    8.2. The client agrees to indemnify and hold the service provider harmless against any claims arising from the content or functionality of the website.

    9. Confidentiality
    9.1. Both parties agree to keep sensitive project details, including login credentials and proprietary code, confidential.

    10. Governing Law
    10.1. This agreement shall be governed by and construed in accordance with the laws of Malaysia.
